Hello, I had a peliminary hearing due to being accused of keying a girls car from my local college. (Which I am no longer attending, and this accusation is false as I never knew the girls) My lawyer said to waive the peliminary hearing, which I did, to go straight to trial. He said it was better for them to not practice their story twice, and doesn't want to give them a chance to speak, as they will lie better the second time. I have a trial on the twenty eighth of this month. BEFORE THE PELIMINARY HEARING:: I was leaving college at 9:40 as my class ended at nine thirty. I went up to get my husband (who got kicked out due to these girls saying he threatened to kill them and which he did not, however, he yelled at them because they were telling him to get out of the classroom when they were on the computer and his class was coming in next. The teacher himself said he said no such thing, however, he got kicked out anyways. I have NEVER spoken to the girls before or knew them prior) and brought him down to his dads house for about two hours, and then ran him back up to my mothers, and came back down and parked and was starting to walk to the school when I was stopped by a police officer. He said that a friend of the girls had saw me key their car (next to the police station, in the noontime, with businesses all around, in the middle of a parking lot) and that I was to leave the college. So I did. But he said that he could not arrest me due to lack of evidence, but it was suspicious enough for him to file the complaint anyways. So I left. And on Christmas, I found out that they were going to try to say that the car costed $1,700 to fix. I do not have that kind of money to pay for a crime I did not commit. I do not know how much the actual fine itself is, but now they're bringing in people to the case that don't have anything to do with it. Like the college director, and the new District Attorney, someone who teaches there. However, I have told the director about the problem I had with them making descrimination comments around me that offended me. But I did not say or do anything to the girls, I kept my mouth shut and continued doing work. I do not see how they will find me guilty as they have no evidence, other than their friend that had supposedly saw me. Is there any input on what the possible outcomes may be? If in the nine chances in hell I DO get found guilty of a crime I did NOT commit, what will happen out of refusal to pay a fine? I never knew these girls, and I have never spoken to them, and it upsets me that I may possibly get found guilty because my husband had problems with them, and I have never done anything myself. I also would like to know if I could still get a medical career if I do have this charge on my record. I will not pay the fine, and I will not plea guilty to something I did not commit. I learned that a long time ago, you do not put yourself and your lover at risk for something to small when you have something to big to make of your own life. Any good advice or legal information will help. I live in Pennsylvania. And to add a little more info, their friend said that she was out in the parking lot watching, while her friend, the owner of the car, was in class. At the seeing of the officer, I was never fingerprinted or anything. I only got asked to tell my story. I have a clean background and will not pay or plea guilty to this atrocity. When the witness/girl cross examine me, should I answer their questions or refuse? What types of questions should I ask ?... Read More »
